Reporting obligations

The Market Transparency Unit for Wholesale Electricity and Gas Markets (MTU Electricity/Gas) is empowered under the Act against Restraints of Competition (GWB) and an ordinance to be issued by the Federal Ministry for Economic Affairs and Energy (BMWi) in accordance with section 47f GWB to define the requirements for the collection of data relating to wholesale electricity and gas transactions.

The MTU Electricity/Gas will, however, make only limited use of this power since most of the data required is collected by the Agency for the Cooperation of Energy Regulators (ACER) under REMIT (Regulation (EU) No 1227/2011 on wholesale energy market integrity and transparency) and forwarded directly to the MTU Electricity/Gas. This means that market participants do not have to provide the same data to two separate bodies.
